Negative Leadership and unfair or disrespectful treatment (against an employee or employees)::a.From the supervisor: Negative, unfair or disrespectful leadership, threats, lack of clarity in instructions, negative ways to monitor tasks. Receive orders to do illegal or unethical acts.
b.Inappropriate treatment between employees, disrespectful or unfair treatment, etc.
Acts of discrimination, physical violence should NOT be reported in this category; or sexual harassment or workplace harassment that involves a persistent attitude over time, these should be reported under Violence and Workplace or Sexual Harassment or Discrimination, depending on the case.
Violence and work or sexual harassment::a.Physical, verbal or psychological violence.
b.Intentional and repeated acts of humiliation over time by one or more people, harassment, including bullying and mobbing.
c.Sexual harassment: unsolicited or consensual acts of physical or psychological sexual violence that intimidate, humiliate and offend.
This category should not be used to report disrespect for an occasion, isolated or mild, these should be reported in Workers' rights and unfair or disrespectful treatment.
Discrimination::Humiliation motivated for racial grounds, age, nationality, customs, sex, political affiliations, sexual preference, physical characteristics, beliefs, among others. Work decisions made based on these elements.
Health and Safety - insecure work conditions::Poor physical workspace conditions, unsafe conditions, use of illegal substances inside the facility or any other circumstance that may endanger the physical health of employees.
Conflict of Interest::When an employee’s personal Interest affects his or her actions and decisions within the company, they should be impartial, objective and professional. A conflict of interest may arise from personal relationships; investments; professional, economic, personal or social activities; other situations. Accept invitations, meals, gifts, trips or other from third parties in exchange for making a decision at the convenience of that third party and not ARCA.
Theft or fraud to the company, or misuse of company assets::a.Theft or fraud to Arca; or misuse of ARCA assets: vehicles, facilities, tools, machinery, computer equipment, company software, company information, brands, etc. It includes theft or fraud done through the alteration of records and information such as inventories, invoices, expense reports, etc.
b.Theft, scams, extortion among employees
Customer thefts should NOT be reported in this category, customer thefts must be reported in Full Relationships with customers who are suppliers and competitors.
Corruption with government officials or undue interactions with government officials. ::Advantages obtained by making payments in money or in kind to government officials; acts of bribery, collusion and untransparent tenders or tenders with government officials. Delivery of money, gifts, and/or benefits on behalf of the company for its own benefit to public government figures or candidates for public office.
NO acts of corruption between private or private individuals should be reported in this category, Conflict of Interest should be used.
Financial, accounting and legal records submitted to the authorities::Manipulation or adulteration of accounting or legal information submitted to government authorities. Reveal financial, accounting, and legal records that are unreliable, complete, and honest in accordance with the rules.
Full and legal relationships with suppliers, customers, consumers and competitors::Unethical or illegal acts committed to the detriment of suppliers, customers, consumers or competitors.
Misuse or leakage of privileged, confidential or personal information::Use of company’s information for personal purposes. Failures in the protection of the privacy and personal data of employees, consumers, suppliers, customers and any other.
Environment::Pollution of rivers, lakes, nature reserves or direct impacts to the ecosystem in a conscious manner
Violation of law and human rights::Violation by ARCA or its employee’s of the Law and/or rules applicable to the territory in which the company is located, other than those mentioned in the previous categories. Human rights, especially forced labor and the employment of minors in the production chain. Suppliers or clients of Arca Continental that violate human rights
Customer Service ::Customer requests, complaints about deficiencies in service and customer service.
Quality of the product::Poor quality or poor condition of company products. Products with defects in packaging, opened or past their expiration date.
Revenge for making a complaint - retaliation ::Actions of punishment or revenge for having reported or made any complaint about any person or fact, by any means including the Transparency Mailbox.
Reports or Complaints Regarding Human Resources Issues::
a.In relation to daily basis or the distribution of the workload.
b.Requests denied by the supervisor (e.g. Holidays, permits, etc.)
c.In relation to payroll: Non-compliance or miscalculation of payments, benefits, days, holidays, bonuses
d.Undue relationships between employees.
e.Political campaigns in the workplace.
